1. Acceptance of Terms
By accessing or using the MinbarLive platform, including the website at minbarlive.com, the web application at app.minbarlive.com, and all related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you and MinbarLive ("we", "us", "our"). We reserve the right to modify these Terms at any time. Changes become effective upon posting to this page. Your continued use of the Service following any changes constitutes acceptance of the revised Terms.
2. Description of the Service
MinbarLive provides a platform for mosques to deliver live khutbah (sermon) captions and multilingual translations to their congregations. The Service includes:
- Real-time audio capture and speech-to-text transcription
- AI-powered multilingual translation of transcribed text
- Browser-based audience access via QR code or direct link
- Administrative tools for mosque operators
- Archive of past khutbah sessions
The Service is provided on an "as is" and "as available" basis.
3. User Categories and Accounts
3.1 Listeners (Audience Members)
Listeners may access the Service without creating an account. By accessing a live session, listeners agree to these Terms. Listeners may not:
- Interfere with or disrupt the Service or its infrastructure
- Attempt to access restricted areas of the Service
- Use the Service for any unlawful purpose
- Redistribute, record, or commercially exploit any content received through the Service without prior authorisation
3.2 Mosque Administrators
Mosque administrators must register an account to use the administrative features of the Service. By registering, administrators agree to:
- Provide accurate and complete registration information
- Maintain the confidentiality of their account credentials
- Accept responsibility for all activity under their account
- Use the administrative tools only for their intended purpose (managing mosque live sessions)
- Ensure they have the right and authority to broadcast audio content through the Service
- Notify us promptly of any unauthorised use of their account
3.3 Account Approval
New administrator accounts are subject to an approval process. We reserve the right to approve, reject, or suspend any account at our sole discretion. Approval of an account does not create any obligation on our part to maintain the account or the Service indefinitely.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to broadcast content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Interfere with, disrupt, or impose an unreasonable burden on the Service or its infrastructure
- Attempt to gain unauthorised access to any part of the Service, other accounts, or computer systems
- Use automated means (bots, scrapers, crawlers) to access the Service without prior written permission
- Reverse engineer, decompile, or disassemble any aspect of the Service
- Use the Service for commercial purposes unrelated to mosque operations without prior agreement
5. Content and Intellectual Property
5.1 Your Content
Mosque administrators retain ownership of the audio content they broadcast through the Service. By using the Service, you grant us a limited, non-exclusive licence to process, transcribe, translate, and display that content for the purpose of providing the Service to you and your audience.
5.2 Our Content
The Service, including its design, code, user interface, branding, and documentation, is owned by MinbarLive and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our content without prior written permission.
5.3 Transcriptions and Translations
Transcriptions and translations generated by the Service are produced using AI and automated systems. While we strive for accuracy, we do not guarantee the accuracy, completeness, or suitability of any transcription or translation. The mosque administrator is responsible for verifying the accuracy of content broadcast to their audience.
6. AI-Generated Content Disclaimer
The Service relies on artificial intelligence and machine learning technologies for speech-to-text transcription and translation. You acknowledge and agree that:
- AI-generated transcriptions and translations may contain errors, inaccuracies, or omissions
- The quality of output depends on factors including audio quality, background noise, accent, speaking speed, and language complexity
- AI translations are automated and may not capture nuances, cultural context, or specific religious terminology with complete fidelity
- The Service should not be treated as a substitute for professional human translation in contexts where precision is critical
- We are not responsible for any misunderstandings, misinterpretations, or disputes arising from AI-generated content
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.
8. Service Availability and Modifications
- We do not guarantee that the Service will be available at all times or without interruption
- We may modify, suspend, or discontinue any aspect of the Service at any time without prior notice
- We are not liable for any loss or inconvenience caused by service interruptions, whether planned or unplanned
- We reserve the right to implement usage limits, rate limits, or other restrictions as necessary to maintain service quality
9. Limitation of Liability
To the fullest extent permitted by applicable law:
- The Service is provided "as is" and "as available" without any warranties of any kind, express or implied
- We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service
- Our total liability for any claim related to the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or EUR 100, whichever is greater
10. Indemnification
You agree to indemnify and hold harmless MinbarLive, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you broadcast through the Service
11. Termination
- We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice
- You may terminate your account at any time by contacting us
- Upon termination, your right to use the Service ceases immediately
- Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of laws provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Zagreb, Croatia.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MinbarLive regarding the use of the Service and supersede all prior agreements and understandings.
